NY v Trump: Judge threatens jail time for 'possibly the next president' for future gag order violations

Judge Juan Merchan warned former President Donald Trump of a possible jail sentence if he continues to violate the gag order imposed in his criminal trial. The gag order, issued before the trial began, restricts Trump from making or directing others to make public statements about witnesses, counsel in the case (other than District Attorney Alvin Bragg), or court and DA staff. Trump has been fined $1,000 per violation and was fined another $1,000 on Monday for an additional violation. Merchan noted that fines are not effective in curbing Trump’s behavior and stated that the court may have to consider a jail sentence for future violations. Although Merchan expressed reluctance about the possibility of incarcerating a former president, he emphasized the seriousness of Trump's continued defiance and its potential consequences. Trump and his defense argue that the gag order violates his First Amendment rights.
